These Terms of Service ("Terms") are a legal agreement between you and Uchhal ("Uchhal", "we", "us" or "our") governing your access to and use of the dias application, the dias.uchhal.in web app, and related backend services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
dias lets you record study/work sessions (timed, audio, video, screen and call), take hand-written notes, run AI-assisted mock interviews, evaluate answers, track goals and progress, and keep everything organised in a personal cloud content drive shared between the mobile app and the web companion at dias.uchhal.in. Features may change, be added or removed over time.

The Service relies on third-party providers (including cloud hosting, storage and AI providers) to function. We are not responsible for third-party services and do not control their availability or performance.
The Service, including its software, design and trademarks, is owned by Uchhal and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.
You retain ownership of the content you submit (recordings, notes, transcripts and other content, "Your Content"). You grant Uchhal a limited licence to process Your Content solely to provide, maintain and secure the Service as described in our Privacy Policy. You are responsible for Your Content and represent that you have the right to submit it.
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use and protect your data.
Any paid plans, credit top-ups or subscriptions are purchased through the web app at dias.uchhal.in, not within the mobile app. Billing terms, pricing and refund policies presented at the time of purchase apply to those transactions.
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Service at any time.
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service or any AI output will be accurate, complete, reliable or error-free.
To the maximum extent permitted by law, Uchhal and its affiliates, officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) INR 5,000.
You agree to indemnify and hold harmless Uchhal and its affiliates from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your recording of others, or your breach of these Terms or of any law.
You may stop using the Service and delete your account at any time (see Delete Account). We may suspend or terminate your access if you breach these Terms or use the Service in a way that could cause harm or legal liability. On termination, your right to use the Service ends; provisions that by their nature should survive (including sections 7, 11, 12, 13 and 15) will survive.
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Subject to applicable law, the courts at the place of Uchhal's principal place of business in India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where changes are significant, provide a more prominent notice. Your continued use of the Service after an update means you accept the revised Terms.
